This Monday there will be a new hearing at the Oral Criminal Court (TOC) 3 of San Isidro regarding the case with nurse Gisella Dahiana Madrid accused of the death of Diego Maradona. During this hearing, it is expected that the start date of the jury trial against the nurse will be defined.
Last week, the Justice rejected the request for suspension of the trial against Gisella Madrid presented by the prosecution, a decision made by Chamber III of the Criminal and Appeals Court of San Isidro. The hearing is scheduled for 10 in the morning and it is estimated that the oral debate could begin on February 25, although the defense will request that it takes place in January during the judicial recess.
Gisella Madrid's lawyer criticized the prosecutors for trying to obstruct the judicial process and emphasized the importance of both Maradona and the nurse knowing the truth about what happened. The lawyer reported to the Justice that the attitude of the prosecution constitutes a violation of the protection granted by the Belem do Pará Convention and described it as a form of institutional gender violence.
Gisella Madrid is accused of alleged "simple homicide with eventual intent" in relation to the death of Diego Maradona, which occurred on November 25, 2020, in a private neighborhood in Tigre. On the other hand, neurosurgeon Leopoldo Luque, psychiatrist Agustina Cosachov, psychologist Carlos Díaz, nurse Ricardo Almirón, his boss Mariano Perroni, and clinical doctor Pedro Pablo Di Spagna, along with the coordinating doctor of a health insurance Nancy Edith Forlini, will face trial on March 11, 2025.
